Andhra Pradesh High Court Enhances Tentative Fees By 10% For 2023-24 Due To Inflation

Amaravati, 31 July: The Andhra Pradesh High Court, in response to a writ petition filed by Andhra Pradesh Private Medical and Dental Colleges Management regarding fee structure, has taken into account inflation and increased the tentative fee for the current academic year 2023-2024 by 10% compared to last year.

The writ petitions challenge the notification issued on 30.06.2022 by the Andhra Pradesh Higher Education and Regulatory Commission, which determines the fees for professional colleges in the state of AP. The petitioners argue that the Respondent did not consider certain expenses when determining the fees.

On the other hand, the Government Pleader for Higher Education and the Government Pleader for Medical, Health, and Family Welfare assert that any delay or interference in the proposed counseling for the MBBS (UG) course, as per the notification, could disrupt the academic year and the availability of seats for the state’s students. Moreover, the fees for the current academic year 2023-2024 are not finalized, and the fees for the previous year 2022-2023 are tentatively considered. Once the entire procedure is finalized, the fee set by the Regulatory Commission will be the final fee.

However, the Petitioners argue that the fee already set for the academic year 2022-2023 should be increased at a minimum percentage rate, considering inflation, and they suggest a 15% increase in the 2022-2023 fee, which would be tentatively considered for the current academic year 2023-2024.

After reviewing the available information, the Court stated that “this Court is of the considered view that inflation is an acknowledged factor by the Government and other public/financial institutions, and an increase in the fee rate is necessary due to rising prices and expenses.”

Therefore, the Court increased the existing fee for the academic year 2022-2023 by 10% for the current academic year 2023-2024. The Respondent was directed to notify the enhanced fee for the current academic year 2023-2024, tentatively set at a rate of 10%, until the final fee is determined according to the AP Higher Education Regulatory and Monitoring Commission Act, 2019 and its accompanying rules.
